ANSWER: The short answer is yes, buying a home without your spouse is possible. But you can’t simply leave your partner off the loan paperwork. States with community property statutes, also known as common-law states, require that any assets obtained during marriage with your spouse be owned/divided equally. Kansas currently does not have a community property law.
Note: Certain types of government loans require your lender to consider your partner’s debt and income when you apply for a loan, even in common-law states.
